Montenegro Supreme Court to Review Do Kwon Extradition Ruling

Montenegro Appellate Court’s recent approval of Terraform Labs founder Do Kwon’s extradition to South Korea has sparked concerns of legal violations. According to recent reports, the Montenegrin Supreme Court is expected to decide whether the extradition judgment has violated the law by the end of this month.

During a talk with local media, acting President of the Montenegrin Supreme Court, Vesna Vučković, asserted that the court will review the Supreme State Prosecutor’s “request for the protection of legality.” The Supreme State Prosecutor alleged that the lower court’s extradition decision had breached the law in several respects.  

Vučković highlighted that the Supreme Court has already postponed Do Kwon’s extradition, considering the prosecutor’s claims of legal uncertainties. She noted that the Supreme Court could not convene a hearing for the prosecutor’s petition due to unforeseen circumstances.

Moreover, she posited that the current situation is particularly concerning as the violations in the extradition decision were identified within a short timeframe. She hinted at the potential consequences of an unfavorable Supreme Court ruling. If the Supreme Court ruled that the lower courts illegally favored the defendant, it could set a bad precedent for Montenegro’s legal proceedings. Vučković stated, “That should worry us because it creates additional legal uncertainty for citizens, but also for judges of lower courts, who monitor judicial practice.”

Do Kwon was arrested at Podgorica airport on March 23, 2023, with securities fraud, wire fraud, and commodities fraud in connection to the fall of Terraform Labs in 2022. In early August 2024, the Montenegro Appellate Court approved his extradition to South Korea to face the charges. However, Judge Seka Piletic halted the extradition process following the Supreme Court Prosecutor’s petition to delay the procedure.
